Captyre Terms of Service

These terms explain how Captyre may be used, what the customer is responsible for, what Captyre provides, and where service, rendering, publishing, billing and availability limits apply.

1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of Captyre.com and any related rendering, automation, publishing, account, subscription and support services provided by Grindhero.com (“Captyre”, “we”, “our”, or “us”). By creating an account, purchasing a membership, submitting a rendering job or using the service, you agree to these Terms.

2. Service description

Captyre provides automated rendering and capture services for slider, HTML-based, browser-rendered and related visual content. Depending on your plan and configuration, Captyre may capture, render, download, schedule, automate or publish generated video output.

Captyre is a technical rendering and automation service. It is not a legal review service, editorial service, moderation service, brand-clearance service, copyright-checking service, advertising-compliance service or permanent file storage service.

3. Customer responsibility for content

You are solely responsible for all content, creative material, media assets, text, audio, images, video, trademarks, logos, data feeds, URLs, scripts, HTML, slider projects and any other materials submitted to, rendered by, captured by or published through Captyre.

You confirm that you own or have all necessary rights, licences, permissions and legal bases to use, capture, render, transform, export, publish and distribute the content you submit to Captyre.

All authoring, legal review, rights clearance, copyright compliance, trademark compliance, advertising compliance, platform policy compliance, age restrictions, claims, permissions, releases and end-publishing decisions are your responsibility.

4. No responsibility for captured content

Captyre does not take responsibility for the legality, accuracy, quality, ownership, suitability, completeness, claims, advertising compliance, platform compliance or rights status of content captured, rendered, generated or published through the service.

Captyre does not review, approve, moderate, author, endorse or verify the visual meaning, legal status or commercial claims of customer content. The fact that Captyre can technically render content does not mean that the content is lawful, permitted, platform-safe, brand-safe or authorised.

5. No visual-content processing or editorial review

Captyre renders browser-visible output as a technical capture process. We do not process, interpret, classify, moderate, fact-check, approve or make editorial decisions about the visual parts of the content.

You must not rely on Captyre to detect illegal content, infringing content, misleading claims, missing disclaimers, regulated content, prohibited advertising, prohibited platform material or content that may violate third-party rights.

6. Publishing endpoints and third-party platforms

If you configure Captyre to send, post, upload or publish output to a third-party endpoint, social platform, ad platform, automation service, API, storage bucket, webhook, website or other destination, you are solely responsible for that endpoint, its permissions, availability, policies, credentials, rate limits and legal compliance.

Captyre is not responsible for rejection, deletion, moderation, account suspension, shadow banning, failed publication, policy enforcement, API changes, credential expiry, endpoint downtime, third-party outages, third-party processing errors or consequences arising after content is delivered to or attempted against a configured destination.

7. Customer-hosted creative and source availability

Captyre may depend on a customer-controlled website, URL, slider, source page, media server, API, script, font, asset host, login session or other endpoint to access and render the creative. You are responsible for keeping that source content available, reachable, stable, correctly configured and legally authorised for capture.

Captyre is not responsible for failed renders, incomplete renders, timing differences, missing assets, broken fonts, missing audio, CORS restrictions, blocked requests, expired URLs, authentication failures, changed DOM output, plugin conflicts, theme issues, third-party script failures, customer-hosting outages or other issues caused by the customer’s source environment.

8. Acceptable use

You must not use Captyre to create, capture, render, automate, distribute or publish content or activity that is illegal, infringing, deceptive, malicious, abusive, harmful, unauthorised, platform-prohibited or designed to interfere with systems or users.

  • You must not submit content you do not have the right to use.
  • You must not use Captyre to violate copyright, trademark, privacy, publicity, advertising, consumer protection or platform rules.
  • You must not attempt to overload, scrape, attack, bypass, reverse engineer or disrupt Captyre or its providers.
  • You must not use Captyre to publish spam, malware, phishing, scams, impersonation, fake endorsements or misleading commercial claims.
  • You must not use stolen credentials, unauthorised endpoints or third-party accounts without permission.

9. Service availability and downtime

Captyre may experience downtime, degraded performance, queue delays, rendering delays, failed jobs, maintenance windows, infrastructure failures, dependency outages or temporary unavailability. Downtime may be unannounced.

Unless expressly stated in a separate written agreement, Captyre does not provide a guaranteed uptime SLA, guaranteed rendering time, guaranteed publishing time, guaranteed queue position or guaranteed uninterrupted availability.

10. Third-party infrastructure and outages

Captyre may rely on cloud hosting, rendering infrastructure, storage, queues, databases, payment providers, email providers, APIs, customer websites and other third-party systems. This may include AWS and other infrastructure providers.

Captyre is not responsible for outages, data delays, processing failures, network failures, rendering failures, payment failures, email failures, publishing failures or access issues caused by AWS, Stripe, email providers, social platforms, third-party APIs, customer endpoints, customer hosting, DNS, CDNs, customer plugins or other external systems outside Captyre’s direct control.

11. Output quality and reclaimable quality issues

Captyre aims to render content accurately, but browser rendering, dynamic assets, animations, source-page performance, external media, audio timing, scripts, fonts and customer-hosted content may affect output. Minor differences may occur between the original creative and rendered output.

A quality issue may be reclaimed only where the generated output contains visible frame drops, audible crackling, visual tearing, severe sync defects, encoding artifacts or rendering artifacts that are not present in the original creative and are reasonably attributable to Captyre’s rendering process.

Quality claims must include the job identifier, source creative, generated output, description of the issue and enough evidence for Captyre to compare the original creative against the generated result. Captyre may, at its discretion, provide a re-render, credit restoration or other reasonable correction.

12. Non-reclaimable issues

The following are generally not considered Captyre quality failures:

  • Errors already present in the source creative.
  • Broken source pages, missing assets, missing fonts, missing audio or broken third-party scripts.
  • Customer-side hosting delays, CORS errors, authentication failures, expired URLs or blocked resources.
  • Content rejected or modified by third-party platforms after export or publication.
  • Incorrect customer configuration, wrong aspect ratio, wrong source URL, wrong schedule or wrong endpoint.
  • Subjective creative preferences, design disagreements or changed customer requirements after rendering.
  • Differences caused by browser, plugin, theme, animation or source-page behaviour outside Captyre’s direct control.

13. Plans, limits and subscriptions

Membership plans may include limits such as rendering seconds, monthly volume, queue priority, connected accounts, automation features, webhook access, publishing targets, expiry periods, rate limits or other service restrictions. Current limits are shown on the pricing or checkout page, inside your account or in plan documentation.

Unused monthly capacity, seconds, credits, limits or included usage do not roll over unless expressly stated. Plan features and limits may change, but active paid customers will receive reasonable notice where required by law or where the change materially affects the paid service.

14. Payments, renewals and cancellation

Paid memberships are billed through Stripe. By purchasing a recurring membership, you authorise recurring charges according to the selected plan until the membership is cancelled or terminated.

You may cancel your membership according to the account, checkout or support flow available on Captyre.com. Cancellation stops future renewal charges but does not automatically refund past charges unless required by law or expressly stated by Captyre. Consumer withdrawal, cancellation or refund rights may apply depending on your location and the type of purchase.

15. Temporary files and deletion

Captyre-created rendering files, generated videos, previews and temporary working files are automatically deleted within 72 hours unless a shorter period applies or temporary retention is needed for abuse, fraud, security, technical or legal reasons.

You are responsible for downloading, exporting, backing up or preserving any output you want to keep before deletion. Captyre is not responsible for outputs deleted according to the normal retention cycle.

16. Account security

You are responsible for maintaining the confidentiality of your account credentials, connected accounts, API keys, webhook URLs, publishing tokens and endpoint credentials. You are responsible for activity performed through your account unless the activity was caused by Captyre’s proven security failure.

17. Suspension and termination

Captyre may suspend, limit or terminate access if we reasonably believe that an account violates these Terms, creates legal risk, causes technical risk, abuses the service, exceeds intended usage, attempts to bypass limits, causes infrastructure harm, violates third-party rights or uses the service unlawfully.

After termination or membership conclusion, customer service records may be deleted as described in the Privacy Policy. Temporary rendering files may expire earlier according to the 72-hour deletion cycle.

18. Intellectual property

You retain ownership of content you submit to Captyre. You grant Captyre a limited licence to access, process, capture, render, encode, store temporarily, transmit and publish that content only as needed to provide the service, operate support, diagnose errors, secure the platform and comply with these Terms.

Captyre, its software, rendering pipeline, platform, workflows, design, branding, code, infrastructure and service methods remain the property of Captyre or its licensors. These Terms do not transfer any Captyre intellectual property rights to you.

19. Disclaimers

Captyre is provided on an “as is” and “as available” basis, except where a separate written agreement states otherwise. We do not guarantee that the service will be uninterrupted, error-free, always available, compatible with every slider, compatible with every website, compatible with every third-party platform or free from queue delays, rendering differences or dependency failures.

We do not warrant that customer content is lawful, non-infringing, platform-compliant, ad-compliant, accurate, commercially effective, suitable for a particular campaign or accepted by any third-party endpoint.

20. Limitation of liability

To the maximum extent permitted by law, Captyre is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data, lost campaigns, failed publication, platform suspension, third-party rejection, customer-hosting failure, endpoint failure or reputational harm.

To the maximum extent permitted by law, Captyre’s total liability for claims relating to the service is limited to the amount you paid to Captyre for the affected service during the one month before the event giving rise to the claim, unless a different limit is required by law or agreed in writing.

21. Indemnity

You agree to defend, indemnify and hold harmless Captyre from claims, damages, liabilities, losses, costs and expenses arising from your content, your endpoints, your publishing destinations, your breach of these Terms, your violation of law, your violation of third-party rights, your misuse of the service or activity performed through your account.

22. Support and inquiries

Support, billing, quality, legal and operational inquiries should be sent to [email protected]. We aim to process and respond to inquiries within 48 hours.

A 48-hour response target does not guarantee resolution within 48 hours. Complex technical issues, third-party provider issues, payment disputes, legal claims, infrastructure incidents or quality investigations may require additional time.

23. Changes to the service or Terms

Captyre may update, improve, limit, modify, suspend or discontinue parts of the service. We may also update these Terms when the service, pricing, providers, legal requirements or operational practices change.

The updated version will be posted on this page with a new “Last updated” date. Continued use of Captyre after updated Terms become effective means you accept the updated Terms.

24. Governing law

These Terms are governed by the laws of the jurisdiction where Grindhero.com is established, unless mandatory consumer protection law gives you rights in another jurisdiction that cannot be waived by contract.
